Veterans of the Law: Many in Judiciary Celebrate JAG Service

Every Nov. 11, America honors the veterans who served this nation. Within the federal Judiciary, many judges have a special link to one part of the military: the Judge Advocate General’s Corps — better known to many as JAG.

The JAG Corps provides judges, prosecutors, and defense lawyers to administer the U.S. military justice system, whose roots date back to the Revolutionary War. More than 65 federal judges (about a quarter of all federal judges with military experience) list time in JAG.

Five veterans share their memories of the JAG Corps:

In interviews, four federal judges and one high-ranking Judiciary official also said the JAG Corps transformed their legal careers, giving them exceptional responsibility and mentorship when they were barely out of law school.

“I tried unbelievable trials, and got fantastic experience in JAG,” said Judge Royce C. Lamberth, of the U.S. District Court for the District of Columbia. He tried 300 cases, including many in combat zones in Vietnam.

Everyone interviewed said their JAG experience shaped their values and legal career.

“I loved putting on that uniform. It humbled me every time I did it,” said Judge Stephanie L. Haines, of the Western District of Pennsylvania. “It was just the honor of a lifetime to say that I supported and was a very small part of the military in service to our country.”

Few Americans have greater insight into the military and civilian justice systems than John S. Cooke. To his own surprise, he rose to brigadier general and the top U.S. Army JAG Corps lawyer in Europe, and today he is director of the Federal Judicial Center, which conducts research and training for the federal Judiciary.

Cooke says the mission of the Army and that of the justice system go hand in hand.

“If people were perfect, we wouldn’t need law and we wouldn’t need armies,” Cooke said. “The army’s mission is to fight the nation’s wars and defend the country. But an unstated part of that mission is to do so in ways that are consistent with the law. If we don’t do that, then what we are defending is going to fall apart from within.”

A self-described amateur historian, Cooke notes that America’s military justice system dates back to the Revolutionary War. Since 1950, the military justice system has been governed by the Uniform Code of Military Justice. While the system has many parallels to the civilian justice system, especially in the areas of rules of evidence and standard of proof, there are distinct differences.

Commanding officers bring charges, convene jurors, and can reduce or even commute sentences. Personnel can be charged with such violations as insubordination or malingering.

When he entered the JAG Corps during the Vietnam War, Cooke recalled, “I had a three-year obligation, and my intent was to serve three years and zero minutes.” 

Once in, he met young lawyers like himself, and supervisors steered him to a succession of challenging assignments. He became a teacher at the JAG school in Charlottesville, Virginia, then a military judge in Germany.

“It was one thing after another, where I had great bosses who gave me opportunities, which led to attractive job offers,” Cooke said. “I just sort of thought, I’ll do a couple of more years. Pretty soon it was a career.”

Army life surprised him in another way. His bosses cared about his well-being and that of his family. “I had seen the Army as a kind of a tough macho organization with cigar-chomping colonels,” Cooke said. “It really was a much more caring organization than a lot of corporations. That has carried with me.”

By the time Cooke left the Army and joined the FJC, in 1998, he had served as the chief judge of the U.S. Army Court of Criminal Appeals. But one of his favorite memories involved an enlisted man who lost his case and was sentenced to prison time in Fort Leavenworth and a bad-conduct discharge.

“After the trial, he told me he wanted to get back on active duty,” Cooke said. “My first thought was it’s a little late to be thinking about that now.”

But Cooke did some research and found there was a way to get a sentence remitted. He explained the process to his client, telling him that it started by being a model prisoner. A few years later, Cooke saw the defendant’s name in an Army Times newspaper article. The headline: “From Court Martial to Soldier of the Month.”

“If you hope to win a lot of acquittals, you’re going to be frustrated, but sometimes you can do a greater service in a different way,” Cooke said. “He did the work; I just did the research. But it was one of my prouder moments.”

U.S. District Judge Stephanie L. Haines, of the Western District of Pennsylvania, had no military tradition in her family, and as a second-year law student, she had zero expectation of signing up. That changed when a fellow law student invited a group of friends to hear a JAG Corps recruiter before they went out to dinner. 

Sitting in a law school auditorium, Haines quietly became transfixed. “I thought, oh my gosh, this is exactly what I want to do,” she recalled. “It’s an opportunity to serve my country. This is where I really see myself.”

Haines was assigned to Fort Campbell, home of the 101st Airborne Division. “I was told, ‘You’re getting ready to enter the oldest, largest, and best law firm in the world’,” she said.

At 8:30 a.m., she was at her desk practicing law. But at 6:30 a.m., she was doing daily physical training like any other soldier.

“We were doing flutter kicks in the mud, running in formation, singing cadence, like what you see on TV,” Haines said. “I was rappelling out of helicopters. You were a lawyer, but you also had to perform well as a military officer.”

Like other JAG lawyers, her first assignment was providing basic legal assistance, such as drafting wills, for soldiers and their families. She next served as a prosecutor, then as a lawyer handling defense appeals. “I can’t say enough great things about the Army JAG Corps and the opportunities they gave me,” Haines said.

After she left full-time duty in 2002, Haines continued as a reserve while she worked as an assistant U.S. attorney, and later transferred to the Air Force reserve. Haines retired as a colonel in 2019, when she became a federal judge.

She remains moved by the spirit she saw, especially among young teenage recruits ready to sacrifice their lives.

“I will say that the 24 and a half years I wore a uniform were absolutely the pleasure and honor of a lifetime,” Haines said. “I was able to serve with true American heroes. People who everyday were duty bound, were loyal, were selfless, courageous men and women who wore that uniform and were willing to lay down their lives in a heartbeat, in defense of their country and in defense of the freedoms we all treasure.”

U.S. District Judge Royce C. Lamberth freely admits he had no interest in joining the JAG Corps. Yet it led to his favorite job ever — and no, he does not mean his current position as a federal judge in the District of Columbia.

Lamberth was drafted in 1967, just as he was graduating from law school. He was reluctant to accept JAG’s required four-year commitment until he realized he was headed for infantry duty. “It was the height of the Vietnam War. Suddenly the JAG Corps didn’t look so bad,” he said.

While the country and the Army were under growing strain, Lamberth found the JAG Corps to be a young lawyer’s dream. “I ended up getting unbelievable experience in JAG. My first trial was a first-degree murder trial. I tried 300 cases in JAG, including six murder trials. I loved my time in JAG Corps, after going in kicking and screaming.”

He did not avoid Vietnam, however. After starting at U.S. installations, Lamberth eventually served in Cam Ranh Bay and the Mekong Delta. The bases were shelled at night, and most days, Lamberth flew by helicopter to hold trials in advance fire bases in hostile territory. It led to extraordinary pressures on the military prosecutor and judge, who flew with Lamberth to the fire bases.

“At the end of the day, you would want to get on the last chopper out. By 4:30, you would stipulate to just about any testimony,” Lamberth said. “You did not want to be on the fire base overnight. Sometimes the fire base could get overrun and everybody would be killed or wounded.”

Lamberth re-upped when his four years ended. At the Pentagon, he joined the litigation division for cases involving the Army in federal court. The unit helped shape new law — including a Supreme Court case that upheld disciplinary actions for behavior unbecoming of an officer. He also persuaded federal courts to uphold the administrative discharges of all soldiers involved in the My Lai massacre.

“These were tremendous cases,” Lamberth said. “It was the best job I ever had, to this day.”

Appointed to the federal bench in 1987, Lamberth presided over the trial of Blackwater Security contractors accused of killing 14 Iraqi civilians in 2007. He sees a close tie between the military’s mission of defending our country and the Judiciary’s mission of upholding the law.

“It’s very important to civil society that we play by the rules and hold ourselves to a higher standard,” Lamberth said. “And we as a country have to do that. I thought it important in Blackwater, I thought it important in My Lai. We as a country, on Veterans Day in particular, need to be proud of what we’ve done.”

Judge Carlos E. Mendoza

U.S. District Judge Carlos E. Mendoza for the Middle District of Florida

U.S. District Judge Carlos E. Mendoza, who serves in the Middle District of Florida, is a first-generation son of naturalized citizens, whose father immigrated from Colombia and whose mother came from Honduras.

Mendoza enlisted in the Marine Corps after high school, serving in Operations Desert Shield and Desert Storm. When he graduated from law school in 1997, he entered the Navy JAG Corps.

“I had a desire to continue serving,” said Mendoza, adding that his parents’ example prepared him for the military’s discipline and service ethic. “Growing up we were always reminded that in this country, unlike almost anywhere else in the world, ambition, hard work, and drive dictate what heights you will reach.”  

The JAG Corps proved to be a tremendous platform for Mendoza’s legal career. “The mentoring of young attorneys/officers is second to none,” he said. “I was impressed that they not only wanted us to become capable attorneys, but honorable people, as well.”

Mendoza does have some criticisms of the military justice system, saying it is tilted against defendants. Commanding officers can bring charges and choose the jury, and only a two-thirds jury majority is needed to convict.

Years before he joined the federal bench, Judge Carlos E. Mendoza served as a Marine in Operations Desert Shield and Desert Storm.

Nonetheless, “my time in the Marine Corps and Navy JAG Corps offered some of the most important lessons of my life,” Mendoza said. “I would not have arrived where I am at now, professionally or personally, had I not had the privilege of walking in the shadows of the many great men and women who gave me their time, friendship, and advice.”

Mendoza sees a close connection between his military service and his duties as a judge. “Lady Justice wears a blindfold for a reason,” he said. “Many men and women have risked and even sacrificed their lives to ensure that the blindfold remains intact.”

He remains grateful for what his military service gave him.

“I am the proud son of working poor immigrants that devoted their entire lives to their children,” Mendoza said. “Considering my humble beginnings, I have no business serving as a United States district judge, except of course in this political experiment of ours, an experiment certainly worth fighting for.”

Judge Carl E. Stewart

Judge Carl E. Stewart, U.S. Court of Appeals for the Fifth Circuit

Judge Carl E. Stewart, of the U.S. Court of Appeals for the Fifth Circuit, received his entire elementary and secondary education in segregated schools.

“It was just a tough time. I was growing up in a period with a lot of hatred,” Stewart recalled. “In school, we often had substandard equipment and books. I had hope that things would get better, but there was no real evidence they would get better.”

Stewart entered law school during the Vietnam war era. After learning that his low draft number would probably result in him being drafted while he was in law school, Stewart joined the Reserve Officers’ Training Corps. By graduating and passing the bar on his first try, he was able to join the JAG Corps as a captain, instead of as a second lieutenant in the regular Army.

“Suffice it to say, I had a lot of incentive to study hard,” Stewart said.

Like other JAG Corps veterans, Stewart was quickly thrown into representing clients. Among his clients at Fort Sam Houston in San Antonio were soldiers in a severe-burn unit.

“I was a 24-year-old lawyer, green as the uniform,” Stewart recalled. “It was a growing up experience. There was no time to be nervous, no time to be scared.”

All JAG lawyers are officers; prosecutors and defense lawyers both wear the same uniforms, which sometimes posed a challenge, Stewart explained.

“You’re talking to a 19-year-old kid and saying anything you say to me is confidential. And that kid says, ‘How can I trust you if you have the same uniform on as the prosecutor?’,” Stewart recalled. “I’m thinking, ‘They didn’t teach me in law school how to cross this bridge.’”

The experience taught him a self-confidence that transformed his career. After the Army, he became a federal prosecutor and was encouraged to seek election as a Louisiana trial judge at age 35.

“I received an extremely valuable lesson in learning about preparation, professionalism, and presenting yourself,” Stewart said. “When I ran for judge, I knew that I could do the job.”

After later becoming a state appellate judge, Stewart was appointed to the U.S. Court of Appeals in 1994. In 2019, he received the federal Judiciary’s highest honor, the Edward J. Devitt Distinguished Service to Justice Award. “I was speechless,” he recalled.

For all his achievements, Stewart says providing service to the burn victims remains one of his greatest satisfactions.

“It drilled into me that being a lawyer is a service profession,” Stewart said. “Mine was a small part, but to know you brought satisfaction to these soldiers and their families, I can’t measure that.”

He added: “I’m proud to be a veteran. I really am. It’s a part of who I am, not just a period of time in my life. I have a flag on my house and it’s flying every day. I have great respect for our country and the honor of those who served.”

    What GAO Found GAO's analysis of the United States Postal Service's (USPS) data found that about 1,065 USPS facilities—about 3 percent of USPS's over 32,000 facilities—sustained damage from 21 weather-related natural disasters from fiscal years 2015 through 2019. The damage, from floods, hurricanes, winter storms and other disasters, cost USPS over $30 million and ranged from broken flag poles to collapsed sections of buildings. USPS officials noted that any amount paid to repair damage is a challenge given USPS's poor financial condition. Impact of Most Costly Weather-Related Natural Disasters on the U.S. Postal Service's Facilities, Fiscal Years 2015–2019 GAO's analysis of USPS and federal climate data found that about one-third (just over 10,000) of USPS's facilities are in areas that may be affected by one or more potential climate change effects including flooding, storm surge, sea level rise, and wildfires. Most of the facilities at risk are post offices, but about one-third of USPS's mail processing and distribution facilities, which are crucial to USPS's ability to process and deliver mail, are also at risk. USPS has taken steps to incorporate climate resilience into its facilities, but its practices are not consistent with its policy to assess climate risk early in its investment process. Several factors can affect USPS's efforts to incorporate climate resilience into its facilities, including competing priorities for limited financial resources and a universal service mission that necessitates having facilities in all parts of the country—even in areas at heightened risk from climate change. Nevertheless, USPS has taken steps to incorporate climate resilience, such as adding resilience requirements to its facility guidance and developing a mapping tool to analyze climate data in its facility investment process. However, USPS currently uses these data at the end of the process, rather than in the preliminary planning steps, as specified in USPS policy. Using the data earlier could help USPS enhance the resilience of its facilities to climate change and ensure that Americans continue to have access to mail that they depend upon. Why GAO Did This Study USPS has one of the largest asset portfolios in the United States. Its post offices and other facilities are essential to the processing and delivery of mail, which millions of Americans rely on for communication and commerce. Weather-related natural disasters resulting from extreme weather events, such as hurricanes, can damage USPS's facilities and present financial and operational risks. According to a recent study, some extreme weather events are projected to become more frequent and intense due to climate change. Investing in climate resilience—taking actions to reduce potential damage by planning for extreme weather events—can help to manage climate change risks. GAO was asked to review the climate resilience of USPS's facilities. This report addresses: (1) how USPS's facilities have been affected by recent weather-related natural disasters; (2) the extent to which USPS's facilities may be affected by climate change effects; and (3) the extent to which USPS has taken steps to incorporate climate resilience into its facilities. GAO analyzed USPS facilities' data and financial data as well as federal climate data; reviewed prior GAO work on climate resilience, the Fourth National Climate Assessment , USPS policies and facility inspection reports; and interviewed USPS officials.

  • Medicaid Behavioral Health: CMS Guidance Needed to Better Align Demonstration Payment Rates with Costs and Prevent Duplication

    What GAO Found In 2016, the Department of Health and Human Services (HHS) selected eight states to participate in a time-limited demonstration to establish certified community behavioral health clinics (CCBHC). These states, in turn, certified 66 behavioral health clinics as CCBHCs. Required to provide a broad range of behavioral health services—mental health and substance use services—CCBHCs are reimbursed by state Medicaid programs using clinic-specific rates designed to cover expected costs. Under the demonstration, states receive enhanced federal funding for CCBHC services provided to Medicaid beneficiaries. GAO found that five of the eight demonstration states reported generally increased state spending on CCBHCs, which officials from these states attributed to an increased number of individuals receiving treatment, an increased array of services provided, or both. In contrast, officials from the other three demonstration states did not report that the demonstration resulted in greater state spending. Officials from two of these states noted that the demonstration resulted in spending decreases, citing factors such as the demonstration's enhanced federal Medicaid funding. Officials from the remaining state said the effects on spending were unknown. In addition, four of the eight states assessed potential cost savings from the demonstration resulting from reductions in the use of more expensive care, such as emergency department visits. Officials from three of the four states viewed the results of their assessments as suggestive of potential cost savings, while officials from the fourth state did not. GAO's review of payment guidance for the demonstration from the Centers for Medicare & Medicaid Services (CMS), an agency within HHS that oversees Medicaid at the federal level, found that the guidance lacked clear and consistent information on better aligning CCBHC payment rates with costs and preventing duplicate payments. For example: CMS guidance gives states the option to rebase their initial payment rates after the first demonstration year (i.e., use data on actual costs incurred and number of client visits during the first demonstration year to recalculate rates for subsequent years). CMS officials said rebasing would mean states would not have to rely on anticipated cost and client visit data after the first year, and would align rates more closely with costs. While officials said CMS expected all states to rebase their rates at some point, CMS's guidance does not reflect this expectation, or provide details on rebasing, such as suggested time frames. CMS guidance conflicts as to whether CCBHCs that are also Federally Qualified Health Centers (FQHC)—safety net providers that generally provide some behavioral health services—should receive CCBHC and FQHC payments for the same client on the same day if provided services overlap. Addressing these weaknesses is important to help ensure that Medicaid CCBHC payments meet requirements for Medicaid payments under federal law, including that they be consistent with efficiency, economy, and quality of care, and are sufficient to ensure access to care. Why GAO Did This Study Behavioral health conditions affected an estimated 61.2 million adults in 2019. Congress has taken steps to expand access to behavioral health treatment, including authorizing the CCBHC demonstration, which is intended to improve the availability of community-based behavioral health services. The CARES Act included a provision for GAO to report on states' experiences participating in the CCBHC demonstration. Among other objectives, this report describes what states reported about how the CCBHC demonstration affected state spending on behavioral health services; and examines CMS guidance for states on Medicaid CCBHC payments. GAO reviewed documentation from and interviewed Medicaid and behavioral health officials from the eight CCBHC demonstration states, as well as federal officials tasked with demonstration oversight. GAO also reviewed documentation and interviewed officials from a nongeneralizable sample of three CCBHCs, which GAO selected for a number of reasons, including variation in geographic location.

  • Information Technology and Cybersecurity: Significant Attention Is Needed to Address High-Risk Areas

    What GAO Found In its March 2021 high-risk series update, GAO reported that significant attention was needed to improve the federal government's management of information technology (IT) acquisitions and operations, and ensure the nation's cybersecurity. Regarding management of IT, overall progress in addressing this area has remained unchanged. Since 2019, GAO has emphasized that the Office of Management and Budget (OMB) and covered federal agencies need to continue to fully implement critical requirements of federal IT acquisition reform legislation, known as the Federal Information Technology Acquisition Reform Act (FITARA), to better manage tens of billions of dollars in IT investments. For example: OMB continued to demonstrate leadership commitment by issuing guidance to implement FITARA statutory provisions, but sustained leadership and expanded capacity were needed to improve agencies' management of IT. Agencies continued to make progress with reporting FITARA milestones and plans to modernize or replace obsolete IT investments, but significant work remained to complete these efforts. Agencies improved the involvement of their agency Chief Information Officers in the acquisition process, but greater cost savings could be achieved if IT acquisition shortcomings, such as reducing duplicative IT contracts, were addressed. In March 2021, GAO reiterated the need for agencies to address four major cybersecurity challenges facing the nation: (1) establishing a comprehensive cybersecurity strategy and performing effective oversight, (2) securing federal systems and information, (3) protecting cyber critical infrastructure, and (4) protecting privacy and sensitive data. GAO identified 10 actions for agencies to take to address these challenges. However, since 2019, progress in this area has regressed—GAO's 2021 rating of leadership commitment declined from met to partially met. To help address the leadership vacuum, in January 2021, Congress enacted a statute establishing the Office of the National Cyber Director. Although the director position has not yet been filled, on April 12 the President announced his intended nominee. Overall, the federal government needs to move with a greater sense of urgency to fully address cybersecurity challenges. In particular: Develop and execute a more comprehensive federal strategy for national cybersecurity and global cyberspace. In September 2020, GAO reported that the cyber strategy and implementation plan addressed some, but not all, of the desirable characteristics of national strategies, such as goals and resources needed. Mitigate global supply chain risks. In December 2020, GAO reported that few of the 23 civilian federal agencies it reviewed implemented foundational practices for managing information and communication technology supply chain risks. Enhance the federal response to cyber incidents. In July 2019, GAO reported that most of 16 selected federal agencies had deficiencies in at least one of the activities associated with incident response processes. Why GAO Did This Study The effective management and protection of IT has been a longstanding challenge in the federal government. Each year, the federal government spends more than $100 billion on IT and cyber-related investments; however, many of these investments have failed or performed poorly and often have suffered from ineffective management. Accordingly, GAO added improving the management of IT acquisitions and operations as a high-risk area in February 2015. Information security has been on the high-risk area since 1997. In its March 2021 high-risk update, GAO reported that significant actions were required to address IT acquisitions and operations. Further, GAO noted the urgent need for agencies to take 10 specific actions on four major cybersecurity challenges. GAO was asked to testify on federal agencies' efforts to address the management of IT and cybersecurity. For this testimony, GAO relied primarily on its March 2021 high-risk update and selected prior work across IT and cybersecurity topics.

  • Drug Pricing Program: HHS Uses Multiple Mechanisms to Help Ensure Compliance with 340B Requirements

    The 340B Drug Pricing Program (340B Program) requires drug manufacturers to sell outpatient drugs at a discount to covered entities—eligible hospitals and other entities participating in the program—in order for their drugs to be covered by Medicaid. Participation in the 340B Program has grown from nearly 9,700 covered entities in 2010 to 12,700 in 2020. The Department of Health and Human Services' (HHS) Health Resources and Services Administration (HRSA) administers the program and oversees covered entities' compliance with 340B Program requirements through annual audits, among other efforts. If audits identify noncompliance with program requirements, HRSA issues findings to covered entities and requires them to take corrective action to continue participating in the 340B Program (see table). Prescribed drugs that may have been subject to both the 340B price and a Medicaid rebate. 429 Total 1,536 Source: GAO analysis of information received from HRSA. | GAO-21-107 HRSA officials told GAO that, beginning in fall 2019, the agency started issuing findings only when audit information presents a clear and direct violation of the requirements outlined in the 340B Program statute. HRSA officials explained that guidance, which is used to interpret provisions of the 340B statute for the purposes of promoting program compliance among covered entities, does not provide the agency with appropriate enforcement capability. For example, HRSA officials reported that there were instances among fiscal year 2019 audits in which the agency did not issue findings for a failure to comply with guidance related to contract pharmacies in part because the 340B statute does not address contract pharmacy use and, therefore, there may not have been a clear statutory violation. In addition to audits, HRSA provides education to covered entities about 340B Program requirements and has implemented other efforts to identify noncompliance. For example, HRSA requires all covered entities to recertify their eligibility to participate in the 340B Program annually (e.g., self-attesting to compliance); and uses a self-disclosure process through which covered entities can disclose and correct self-identified instances of noncompliance. Covered entities can realize substantial savings through 340B Program price discounts, enabling them to stretch federal resources to reach more eligible patients and provide more comprehensive services. GAO was asked to provide information on HRSA's efforts to oversee covered entities' compliance with 340B Program requirements. This report describes (1) the audit findings that HRSA issued to address covered entity noncompliance with 340B Program requirements; and (2) other efforts HRSA uses to help ensure that covered entities comply with 340B Program requirements. GAO reviewed documentation, including relevant federal laws and regulations and HRSA's policies, procedures, and guidance, related to 340B Program oversight. GAO also reviewed HRSA data on the number and type of audit findings made from audits finalized during fiscal years 2012 through 2019 as of September 2020—the latest data available at the time of the audit.     A three-count criminal indictment was unsealed yesterday in federal court in the Eastern District of New York charging Roberto Gustavo Cortes Ripalda, 54, of Madrid, Spain; Fernando Haberer Bergson, 48, of Buenos Aires, Argentina; and Ernesto Heraclito Weisson Pazmino, 53, of Miami, Florida, with conspiring to defraud investors and financial institutions as part of an international fraud scheme stretching through the United States, South America, and Europe. The defendants are each charged with conspiracy to commit wire fraud, conspiracy to commit bank fraud, and conspiracy to commit money laundering. Federal agents arrested Weisson in Miami yesterday. Cortes and Haberer were also arrested yesterday in Spain and Argentina, respectively.

  • Priority Open Recommendations: Department of Defense

    What GAO Found In May 2020, GAO identified 81 priority open recommendations for the Department of Defense (DOD). Since then, DOD has implemented 21 of those recommendations, leading to improvements in readiness rebuilding efforts, cybersecurity, and the Navy's force structure, among other areas. Additionally, GAO closed four priority recommendations related to DOD enterprise-wide business reform as unimplemented because the recommendations are no longer relevant. GAO also removed one priority recommendation related to acquisition oversight because it no longer warranted priority attention due to actions taken by the military departments. Thus, reducing the number of remaining priority open recommendations to 55. In July 2021, GAO identified 26 additional priority recommendations for DOD, bringing the total number to 81. These recommendations involve the following areas: acquisitions and contract management; rebuilding readiness and force structure; financial management; cybersecurity and the information environment; health care; driving enterprise-wide business reform; preventing sexual harassment; and strengthening diversity, equity and inclusion within DOD. DOD's continued attention to these issues could lead to further improvements in the department's operations.   • Unaccompanied Children: Actions Needed to Improve Grant Application Reviews and Oversight of Care Facilities

    The Office of Refugee Resettlement's (ORR) grant announcements soliciting care providers for unaccompanied children—those without lawful immigration status and without a parent or guardian in the U.S. available to provide care and physical custody for them—lack clarity about what state licensing information is required. Further, ORR does not systematically confirm the information submitted by applicants or document a review of their past performance on ORR grants, when applicable, according to GAO's analysis of ORR documents and interviews with ORR officials. The grant announcements do not specify how applicants without a state license should show license eligibility—a criterion for receiving an ORR grant—or specify what past licensing allegations and concerns they must report. In addition, the extent to which ORR staff verify applicants' licensing information is unclear. In fiscal years 2018 and 2019, ORR awarded grants to approximately 14 facilities that were unable to serve children for 12 or more months because they remained unlicensed. In addition, ORR did not provide any documentation that staff conducted a review of past performance for the nearly 70 percent of applicants that previously held ORR grants. Without addressing these issues, ORR risks awarding grants to organizations that cannot obtain a state license or that have a history of poor performance. State licensing agencies regularly monitor ORR-funded facilities, but according to GAO's survey of these agencies, their information sharing with ORR is limited (see figure). State licensing agencies and ORR staff both said that improved information sharing would benefit their monitoring of facilities. Without such improvements, ORR may lack information about ongoing issues at its facilities. Key Survey Responses on Information-Sharing with the Office of Refugee Resettlement (ORR) by the 23 State Agencies That Licensed ORR-Funded Facilities in Fall 2019 ORR requires grantees to take corrective action to address noncompliance it identifies through monitoring, but ORR has not met some of its monitoring goals or notified grantees of the need for corrective actions in a timely manner. For example, under ORR regulations, each facility is to be audited for compliance with standards to prevent and respond to sexual abuse and harassment of children by February 22, 2019, but by April 2020, only 67 of 133 facilities had been audited. In fiscal years 2018 and 2019, ORR also did not meet its policy goals to visit each facility at least every 2 years, or to submit a report to facilities on any corrective actions identified within 30 days of a visit. Without further action, ORR will continue to not meet its own monitoring goals, which are designed to ensure the safety and well-being of children in its care. ORR is responsible for the care and placement of unaccompanied children in its custody, which it provides through grants to state-licensed care provider facilities. ORR was appropriated $1.3 billion for this program in fiscal year 2020. GAO was asked to review ORR's grant making process and oversight of its grantees. This report examines (1) how ORR considers state licensing issues and past performance in its review of grant applications; (2) state licensing agencies' oversight of ORR grantees, and how ORR and states share information; and (3) how ORR addresses grantee noncompliance. GAO reviewed ORR grant announcements and applications for fiscal years 2018 and 2019. GAO conducted a survey of 29 state licensing agencies in states with ORR facilities, and reviewed ORR monitoring documentation and corrective action reports. GAO also reviewed ORR guidance and policies, as well as relevant federal laws and regulations, and interviewed ORR officials. GAO is making eight recommendations to ORR on improving clarity in its grant announcements, communication with state licensing agencies, and monitoring of its grantees.
